If you contact me via the contact form or email, I process your details (name/company, email address, message) to handle your request and follow-up questions.
To prevent abuse, the contact form also processes technical checks (timestamp, signature, and a short-lived hash from IP address and user agent for rate limits).
Legal basis: Art. 6(1)(a) GDPR (consent via form checkbox), Art. 6(1)(b) GDPR (pre-contractual measures), and Art. 6(1)(f) GDPR (security/abuse prevention).
Retention period: content data generally up to 3 years after the last contact, unless longer statutory retention obligations apply; technical protection data only short-term (seconds/minutes).

§ 1 Scope and contracting party

These General Terms and Conditions (T&C) apply to all contracts for web design services, consulting, and the provision of digital goods (such as WordPress themes) concluded between Tom der Medienmacher (Thomas Zwicklhuber), Hauptstraße 43/3, 4542 Nußbach, and his customers.

§ 2 Conclusion of contract

A contract is concluded when the customer accepts an offer (in writing or by email). Offers from Tom der Medienmacher are non-binding unless agreed otherwise.

§ 3 Services and remuneration

Services and prices are based on the individually agreed offer or the fixed-price packages communicated on the website.
All prices are exclusive of statutory VAT unless indicated otherwise under Section 6(1)(27) UStG (small business regulation).
Unless stated otherwise on the invoice, invoices are due within 14 days from invoicing without deduction.

§ 4 Customer responsibility (content)

The customer is responsible for providing the content (texts, images) required for service delivery. The customer warrants that they hold the necessary rights and that no third-party rights are infringed.

§ 5 Copyright and usage rights

All intellectual property rights arising from service delivery remain with Tom der Medienmacher. After full payment, the customer receives a simple, non-transferable right of use for the agreed purposes. Modifying the code (theme/design) is permitted only with a corresponding full license or written approval.

§ 6 Duties to cooperate

The customer undertakes to provide all documents and information required for project implementation in full and in due time. Delays caused by the customer extend any agreed deadlines accordingly.

§ 7 Liability

The liability of Tom der Medienmacher is limited to intent and gross negligence. Liability for lost profits, data loss, or indirect damages is excluded to the extent permitted by law. In particular, no liability is assumed for the legal compliance of provided legal texts (legal notice, etc.); this remains the customer’s responsibility together with their legal counsel.

§ 8 Reference mention

Unless expressly agreed otherwise, Tom der Medienmacher is entitled to mention the customer and the created work as a reference on his website (medienmacher.biz) and in his portfolios.

§ 9 Dispute resolution

Complaints can be sent to tom@medienmacher.biz. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. The former EU online dispute resolution platform (ODR) was discontinued on July 20, 2025.

§ 10 Final provisions

If individual provisions of these T&C are invalid, the validity of the remaining provisions remains unaffected. Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. Place of performance and jurisdiction, where legally permissible, is the registered office of Tom der Medienmacher. Contract language is German.
